Return and Refund Policy

This Return and Refund Policy (“Policy”) outlines the terms and conditions governing cancellations, returns, and refunds for purchases made via the Ekk Marketplace platform (hereinafter referred to as “Platform”), operated by Ekk Marketplace Pvt. Ltd. (“Company,” “We,” “Us,” or “Our”).

By using the Platform, You (“User,” “Buyer,” or “You”) agree to the terms of this Policy. This Policy applies exclusively to transactions facilitated through the Platform and governs the relationship between You, the Company, and any sellers whose Goods are listed on the Platform.

Order Cancellation Policy

Cancellation Rights

  1. Pre-dispatch Cancellations:
    • Buyers may cancel an Order at any time before the Goods are dispatched by the seller. The right to cancel is subject to the cancellation terms and conditions set by the seller, which shall take precedence.
  2. Cancellation Process:
    • Cancellations must be initiated through the Platform using the cancellation option provided in the User’s account dashboard.

Refund for Cancellations

Upon successful cancellation of an eligible Order:

Conditions for Returns

To be eligible for a return, the following conditions must be met:

  1. The Goods must have been purchased within 7 calendar days or as otherwise specified in the seller’s return policy.
  2. The Goods must be returned in their original condition and packaging, free from damage, tampering, or use, unless defective upon delivery.

Non-Returnable Goods

The following categories of Goods are not eligible for return:

Refund for Sale Items

Refunds are only available for Goods sold at their regular price. Sale or discounted items are ineligible for refunds, except where otherwise mandated by applicable law.

Returning Goods

Return Process

  1. Responsibility for Returns:
    • Buyers bear the cost and risk of returning Goods unless otherwise specified by the seller.
  2. Return Address:
    • The specific return address for the Goods shall be communicated via email upon initiation of the return process.
  3. Proof of Return:
    • It is the Buyer’s responsibility to ensure Goods are returned using a secure and trackable method. The Company shall not be liable for loss, damage, or non-receipt of Goods in transit. Refunds will only be processed upon confirmation of the returned Goods’ receipt by the seller.

General Provisions

  1. Role of the Company:
    • The Company operates as an intermediary between Buyers and Sellers. It neither owns nor sells Goods listed on the Platform and bears no responsibility for the quality, legality, or suitability of the Goods.
    • The Company shall not be held liable for disputes arising between Buyers and Sellers, including but not limited to non-fulfillment of Orders, delayed delivery, or defective Goods. Such disputes shall be resolved directly between the parties.
  2. Governing Law:
    • This Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising under this Policy shall be subject to the exclusive jurisdiction of the courts in Varanasi, Uttar Pradesh.
  3. Amendments:
    • The Company reserves the right to amend, modify, or update this Policy at any time without prior notice. Users are encouraged to review this Policy periodically.
